Digital lockers a growing piracy concern

Digital storage services like Megaupload, which was accused of criminal copyright violations on Thursday, play a small but growing role in a broader piracy problem that continues to evolve and dog the entertainment industry.

Some 3 million Americans every month used Megaupload, which is among the largest digital lockers, the Recording Industry Association of America (RIAA) said. Other entertainment executives said that number surged when other sites popular with digital pirates, such as LimeWire, were taken down.

"When we look at piracy behavior and uncompensated theft of music, a significant portion of consumer behavior migrates toward these locker sites" after shutdowns, said Victoria Bassetti, a music industry consultant and former anti-piracy chief at record label EMI.

"Anecdotally, when we have pre-release leaks, the first week there is a massive amount of consumer trade that goes directly to Megaupload's door."

Peer-to-peer systems like BitTorrent, which have little central coordination and are harder to stop, still have about three times as much usage among consumers as digital lockers, said NPD market researcher Russ Crupnick.

Only about 3 percent of the U.S. Internet audience relied on digital storage for legitimate purposes or piracy in the third quarter, he said.

Megaupload and its ilk may be a bigger factor in video piracy because movies take much longer to download via peer-to-peer networks, Crupnick said. Digital lockers allow anyone to upload, store and distribute links to most forms of electronic content.

The U.S. Justice Department released an indictment Thursday accusing Megaupload's founders and other officers of criminal conspiracy, arguing that they encouraged copyright violations and in some cases copied protected content themselves. Four people involved with the site were arrested in New Zealand.

The indictment cited internal emails referring to piracy and Megaupload's policy of rewarding users whose content was downloaded most often, which prosecutors said encouraged the distribution of prime Hollywood fare.

An attorney for the company said Friday that the site merely allowed users to upload material and that it would fight the charges.

RIAA spokesman Jonathan Lamy said that lockers were "generally the fastest growing form of Internet piracy."

Like other shutdowns, the interruption of Megaupload will send some pirates to rivals but should encourage others to buy or rent content legally, Lamy said.

"The realistic objective is not to eliminate piracy but to make it as inconvenient as possible," he said. "Some of the users you peel off."

The takedown enraged some Internet activists, who launched denial-of-service attacks that temporarily rendered websites of the Justice Department, FBI and big entertainment companies unreachable.

Some of them argued that the arrests showed that there was no need for laws like those that were withdrawn from consideration in Congress this week that would have made it much easier to block access to sites accused of fostering piracy.

But entertainment executives said that they would try again to pass such bills because they are aimed more at attacking demand rather than supply. In addition, many file-sharing sites do not have Megaupload's ties to the United States or allied countries.

"It is not hard necessarily to do something in New Zealand, but it is hard to get people in Russia and China," Bassetti said.

"Invisible War" exposes widespread rape in U.S. military (Reuters)

PARK CITY, Utah, Jan 22 (TheWrap.com) ? Rape in the American armed forces is an issue that has quietly been gathering attention over the past decade. But it exploded with the power of suppressed fury at the Sundance festival's Friday afternoon screening of the documentary "The Invisible War," a devastating indictment of the government's inaction on the issue.

Director Kirby Dick brought a powerful weapon to his film: victim after eloquent victim, Navy, Marine, Coast Guard, Army and Air Force veterans who were assaulted by fellow officers, supervisors or recruits.

They tell their stories in courageous detail, and it quickly becomes clear that these are not isolated incidents but a pattern reflective of a widespread rot within America's military institution, one that betrays its essential values.

The individuals Dick chose as the principal characters in his film -- there were so many to choose from -- were among the best of their class. They were women (and in some cases, men) who joined the military out of devotion to country and a desire to serve.

One Marine, Ariana Klay, was raped by a fellow officer in the elite Marine Barracks in Washington, D.C.

A Navy officer, Trina McDonald, was drugged and raped repeatedly by fellow officers on a remote base in Alaska.

Coast Guard recruit Kori Cioca was raped and then assaulted -- smacked so hard in the face that it dislocated her jaw, causing her permanent damage and pain for which the Veterans Administration declines to provide medical coverage.

One woman who was assaulted had previously been a military investigator of crimes. Rape investigations were always steered away from the women, she recounted, because they would be "too sympathetic."

Every woman in the film has had her life shattered by this event -- not necessarily because of the rape, but because of the response by the military establishment.

After lodging complaints, the women were met with indifference or targeted retaliation. They have had to leave the military. Some were threatened with violence.

For each, the betrayal by their colleagues and by an institution they trusted deeply has been a wound that, as one military psychologist affirms, cuts to "the soul."

Almost none of the alleged perpetrators were brought up on charges or punished in any way. Some have gone on to rape again, in the military or the private sector.

Kirby, who took on the Catholic Church's indifference to sexual abuse in "Twist of Faith," hopes the film will mobilize change in a way that lobbying and newspaper journalism so far have not.

Two obvious policy changes are necessary: better screening of new recruits to winnow out potential predators, and moving the authority for investigating and prosecuting rape into indendent hands. At the moment, local commanders have nearly all the power in these matters.

The military "has to admit they have a problem," Dick said at the Q&A after the screening, where more than a half-dozen victims stood and received applause.

"They need another mind-set to attack this issue."

The movie, which does not yet have distribution, profoundly shocked the audience. One military recruiter stood and asked for the names of the bases involved so she could steer female enlistees away from known risk areas. A 17-year-old girl stood up in tears and thanked the women for speaking out.

But there was one inspiring surprise after the screening. A couple in the audience approached Cioca and told her they will pay for the surgery to repair her jaw, which causes her pain every day. The cost is around $60,000, and without V.A. medical coverage she cannot afford it.

Cioca was overwhelmed. The couple, an investment banker and his wife, said they preferred to remain anonymous.

Teen ends globe-circling voyage in St. Maarten (AP)

PHILIPSBURG, St. Maarten ? Laura Dekker set a steady foot aboard a dock in St. Maarten on Saturday, ending a yearlong voyage aboard a sailboat named "Guppy" that apparently made her the youngest person ever to sail alone around the globe, though her trip was interrupted at several points.

Dozens of people jumped and cheered as Dekker waved, wept and then walked across the dock accompanied by her mother, father, sister and grandparents, who had greeted her at sea earlier.

Dekker arrived in St. Maarten after struggling against high seas and heavy winds on a final, 41-day leg from Cape Town, South Africa.

"There were moments where I was like, 'What the hell am I doing out here?,' but I never wanted to stop," she told reporters. "It's a dream, and I wanted to do it."

Dekker claims she is the youngest sailor to complete a round-the-world voyage, but Guinness World Records and the World Sailing Speed Record Council did not verify the claim, saying they no longer recognize records for youngest sailors to discourage dangerous attempts.

Dutch authorities tried to block Dekker's trip, arguing she was too young to risk her life, while school officials complained she should be in a classroom.

Dekker said she was born to parents living on a boat near the coast of New Zealand and said she first sailed solo at 6 years old. At 10, she said, she began dreaming about crossing the globe. She celebrated her 16th birthday during the trip, eating doughnuts for breakfast after spending time at port with her father and friends the night before in Darwin, Australia.

The teenager covered more than 27,000 nautical miles on a trip with stops that sound like a skim through a travel magazine: the Canary Islands, Panama, the Galapagos Islands, Tonga, Fiji, Bora Bora, Australia, South Africa and now, St. Maarten, from which she set out on Jan. 20, 2011.

"Her story is just amazing," said one of Dekker's fans, 10-year-old Jody Bell of Connecticut. "I can't imagine someone her age going out on sea all by herself."

Bell was in St. Maarten on a work trip with her mother, Deena Merlen, an attorney in Manhattan, who wanted to see Dekker complete her journey. The two wore T-shirts that read: "Guppy rocks my world."

"My daughter and I have been following Laura's story, and we think it's amazing and inspiring," Merlen said.

Unlike other young sailors who recently crossed the globe, Dekker repeatedly anchored at ports along the way to sleep, study and repair her 38-foot (11.5-meter) sailboat.

During her trip, she went surfing, scuba diving, cliff diving and discovered a new hobby: playing the flute, which she said in her weblog was easier to play than a guitar in bad weather.

Dekker also complained about custom clearings, boat inspections, ripped sails, heavy squalls, a wet and salty bed, a near-collision with two cargo ships and the presence of some persistent stowaways: cockroaches.

"I became good friends with my boat," she said. "I learned a lot about myself."

Highlights of her trip include 47 days of sailing the Indian Ocean, which left her with unsteady legs when she docked in Durban, South Africa, where she walked up and down the pier several times for practice.

While in South Africa, she also saw her first whale.

"It dove right in front of my boat and got all this water on my boat, and that wasn't really nice," she said.

Dekker launched her trip two months after Abby Sunderland, a 16-year-old U.S. sailor, was rescued in the middle of the Indian Ocean during a similar attempt. Jessica Watson of Australia completed a 210-day solo voyage at age 16, a few months older than Dekker.

Dekker had said she planned to move to New Zealand after her voyage, but she said Saturday that she wants to finish school first. If she goes to New Zealand, she said, she'd like to sail there.

PSU trustees install new leadership (AP)

STATE COLLEGE, Pa. ? Penn State's Board of Trustees elected banking executive Karen Peetz to lead the embattled board and help the school negotiate the aftermath of a nightmarish child sex abuse scandal involving a former assistant football coach.

The trustees picked Peetz to be president of the 32-member board in a voice vote Friday. She is vice chairman of The Bank of New York Mellon. The trustees also elected farm owner Keith Masser as the vice chair. Like Peetz, he was unopposed.

They're replacing Steve Garban and John Surma, respectively, who guided the board in the two tumultuous months since Jerry Sandusky was charged with dozens of counts of child sex abuse. They decided not to run for another yearlong term as board officers.

Under Garban and Surma's watch, the board ousted football coach Joe Paterno and promised to uncover the truth behind the Sandusky case and Penn State officials' involvement in it through an internal investigation.

In recent weeks, the trustees have felt increasing heat from some former alumni and players critical of how Paterno's firing was handled, and what's been seen as a lack of openness on the board.

"The first thing I want to say to the entire Penn State community is that we have been through a very difficult experience together. We have tried to do the right thing," Peetz said. "All of us, including the board, with the wisdom of hindsight could have done things differently."

She said the board agreed it would focus on three themes ... "the first is change, the second is reform and the third is transparency."

Sandusky, a longtime defensive coordinator who helped Paterno win two national titles, is out on bail and awaiting trial after denying charges that he abused 10 boys over 15 years.

The scandal resulting from his arrest Nov. 5 has had wide-ranging implications going beyond Paterno and the storied football program.

Since Sandusky was charged, the university has cited its status as a state-related university ? along with Temple, Pitt and Lincoln ? in denying requests by The Associated Press for documents related to a 1998 investigation into Sandusky that began when a woman complained he had showered with her son, a copy of his severance agreement and emails among top administrators about Sandusky.

Some state lawmakers have called for a change in the commonwealth's three-year-old open records law to get rid of an exemption that allows Penn State and the other state-related universities to keep their operations out of the public eye while receiving taxpayer money.

"We have to decide, the board has to decide, whether they're going to be a public entity that receives public funds or a private entity," said Gov. Tom Corbett, who also is a trustee. "But it is something that is incumbent on the board in the next few weeks and months that the decision has to be made."

The board is also undertaking its own investigation into the case. Ken Frazier, the trustee overseeing the effort, said results of the probe may now not come until next fall ? if then. Frazier added there was no "artificial timetable" ? he wants to give investigators ample time for thorough questioning.

Trustees have tabbed former FBI director Louis Freeh as their lead investigator. Frazier maintained Freeh, who has an office on campus, had free rein over the investigation and would not be beholden to pressures from the board or other university administrators.

Peetz also reiterated that the university "will find a way to make sure Penn State helps the victims of this tragedy.

"Immediately, we will reach out to the victims we know of and seek to pay for their abuse-related health costs, to pay for related counseling that they've had to have to date and pay for counseling going forward related to abuse," she said. School President Rodney Erickson declined to give a range about how much it might cost.

General counsel Cynthia Baldwin said the university has been served legal notice that it was the subject of a second civil complaint related to the Sandusky case, though the lawsuit had not been filed. The first known civil suit was filed in late November.

The departures of Garban and Surma from leadership positions had nothing to do with the investigation, Frazier said. Garban had decided in November to step aside as the chairman, citing his past ties to the university and as a former football player.

Surma, an executive at U.S. Steel, said the duties of the board during the scandal increasingly took much time away from his job.

The board also approved five recommendations from Freeh, including a strengthening of school policies for programs involving minors; prompt reporting of allegations of abuse; and increased security measures within the athletic department.

It was the trustees' first meeting since the chaotic week in November after Sandusky was charged, when Paterno was dumped and former school president Graham Spanier also was pushed out.

The meeting, in the ballroom of a campus hotel, drew a larger-than-normal crowd of at least 200 people, including a couple of candidates hoping to win election to the board this spring. Former Penn State running back Franco Harris, a vocal critic of the administration and a Paterno supporter, also attended and held a question-and-answer session afterward attended by about 100 people.

They listened to Harris and another critic, prominent donor and alumni Anthony Lubrano, air their grievances about the firing of Paterno and the way Penn State's Board of Trustees functions. There were several white poster boards propped up in the front of the room with famous Joe Paterno quotes.

The crowd was very receptive to the duo, nodding their heads with each points and, at times, erupting into applause.

"It's going to take people like you, here in this room, spreading the word," Harris told the crowd. "It's not a Penn State sex scandal, it's not a Penn State football sex scandal, it's not a Joe Paterno sex scandal. It's a Jerry Sandusky sex scandal. And what the board did was wrong."

The trustees have said Paterno was ousted in part because he had a moral obligation to pass on to police a 2002 allegation that was relayed to him by a graduate assistant. Paterno told his superiors at the university about the accusation, and authorities have said the coach is not a target of their criminal investigation.

"We still have respect and gratitude for coach Paterno's legacy and for his many contributions to Penn State," Peetz said, "and to (fired school President Graham) Spanier for his years of dedicated service and leadership."

She said they intended to honor Paterno at a future date, though the timing was uncertain given Paterno is being treated for lung cancer.

The Nike+ FuelBand measures activity in NikeFuel, ready for your NikeLife

While Nike might have beat competitors like the MotoACTV and Jawbone Up to the active bracelet market over two years ago, its original endeavor, the Nike+ SportBand, was getting long in the tooth. That changes today with the introduction of the far sleeker Nike+ FuelBand. It's much in the vein of the original, except boasts a more attractive 20 LED dot-matrix display and can measure activity in a new unit the company calls NikeFuel. That latter bit is a normalized score that unlike calories "awards equal points for the same activity regardless of physical makeup." We'll have to see about that, but we're definitively smitten with its design and that row of colorful LEDs that progressively fills as one gets closer to reaching their intended goal. The $149 pre-orders go live on the company's online store at 5PM ET, but those interested ought to peep the PR and video after the break.

Fed releases template for rate forecasts (Reuters)

WASHINGTON (Reuters) ? The Federal Reserve previewed its new practice of announcing policymakers' interest rates projections on Friday, issuing a table that showed analysts may be able to guess where the policy consensus lies.

One blank chart, which extends out to 2016, will show the distribution of expectations for the first policy tightening following years of near-zero interest rates.

Another panel, which will show forecasts for the benchmark federal funds rate over time, could give observers the chance to see where individual officials' forecasts lie, although the estimates will not be linked to particular names.

Some analysts thought they might be privy only to the range of forecasts, not the distribution of forecasts along that range. When the Fed has released its economic forecasts in the past, the public has had to wait for the release of meeting minutes three weeks later to get that level of clarity.

The Fed recently announced its decision to publish official forecasts for rates, in addition to the projections for employment, inflation and growth that they already release quarterly.

NVIDIA announces DirectTouch technology for Tegra 3 tablets, promises a smoother touch experience

You'd think that with Tegra 3 shipping in the Transformer Prime and all, we'd know everything there is to know about the new SoC. Apparently not. NVIDIA just announced DirectTouch, a technology exclusive to its Tegra 3 platform that uses that bonus fifth core for to improve touch detection. So what does a low-power core have to do with the touch experience, you say? Essentially, what's going on is NVIDIA's PRISM Display technology separates color and backlight intensity to save battery life while preserving fidelity. In a demo, the technology looked mighty smooth, though we'll need to get hands-on ourselves and see the technology in action for more than five seconds before we can weigh in on its utility.

96% Tomboy

Tomboy was a powerful French film of director Celine Sciamma , which brought a good character study of a 10 year old girl. Played by Zo? H?ran, she was Laura who moved into a new town and introduced herself as a boy. The film created a moving portrait of a lonely girl longing for acceptance, being very quiet, mostly observations she did, as she adapted herself to her new world. She maintained being the boy only to make friends but then it draw her in nothing else then complications. It think it was difficult to capture the simple, honest, and often cruel world of children, but Sciamma showed a natural ability to come with perfect dialogue and she directed these children so well that it all came to perfection.Obviously things won't end well, but when Mikael was finally discovered it was refreshingly believable,showing that people could get hurt, and it was painful to watch when it comes to children.But still it ended with a hopeful note. It's an uplifting, and such powerful film.

Auto major Ford has unveiled its plans to recycle nearly 2 million plastic bottles being sent into landfills. The plastic bottles will be processed into REPREVE recycled fibers, which will be used in the manufacturing of seat fabric for its new vehicles.

The car maker will collect plastic bottles throughout the year, beginning with the North American International Auto Show and Consumer Electronics Show in the US.

Nearly 22 recycled plastic bottles are used in the making of the seat fabric of each car, said Ford. It will reduce the waste disposal problem pertaining to plastic bottles, including PET bottles.

The firm has adopted a plan to use minimum of 25% recycled materials for all 2009 and beyond model year vehicles.
